| theflyonthewall.com: | Acacia Technologies could get a boost if Yahoo settles the appeal, BusinessWeek | | Acacia Technologies (ACTG) which acquires and licenses patented wireless and Web technologies, moves in part on the fate of its lawsuits. The stock could get a lift on a pending case with Yahoo! (YHOO). On May 15, a U.S. District Court in Tyler, Tex., awarded Acacia $6.6M in damages for its net-related patent suit against Yahoo. Acacia then appealed to increase the damages. If Yahoo settles, Acacia will get a boost. Jonathan Skeels of investment outfit Davenport says, "Our Q4 sales estimate of $13.5M and earnings of 1c a share could be low if the Yahoo case goes well." Skeels has a Buy rating on the shares. Acacia has a slew of lawsuits against other biggies, including Oracle (ORCL), AT&T (T), and Google (GOOG), he notes. Reference Link :theflyonthewall.com |

| theflyonthewall.com: | Google wins online books settlement preliminary approval, Bloomberg reports | | U.S. District Judge Denny Chin, in a ruling filed Thursday in New York, granted Google (GOOG) and a group of authors and publishers preliminary approval of a revised online book settlement, Bloomberg reports. Under the $125M agreement, Google will set up a Book Rights Registry with publishers and authors to compensate copyright holders whose works are scanned. It also would seek to identify and compensate the rights holders of so-called orphan works whose owners aren’t currently known. “This is not a surprising development and is not any indication that the court will or will not accept the terms of Settlement 2.0,” The Open Book Alliance said in an e-mailed statement Thursday. The Open Book Alliance, which includes online retailer Amazon.com Inc. (AMZN) and Microsoft Corp. (MSFT), has opposed the settlement, both of which have said they would like to enter the online book-publishing business too. A hearing for final approval is set for Feb. 18.
