GE Hitachi Nuclear Energy announced that its Economic Simplified Boiling Water Reactor design certification has been approved by the U.S. Nuclear Regulatory Commission. The commission’s action acknowledges the finding by NRC staff that the ESBWR design meets all safety and regulatory requirements. Per the NRC’s previously published schedule, the final ESBWR design certification rule is expected to be published in the Federal Register by the end of September.

AMSC issued several updates regarding its litigation with Sinovel Wind Group. In the trade secret infringement case, the Beijing Higher People's Court upheld AMSC's position by rejecting Sinovel's appeal to transfer the case to the Beijing Arbitration Commission. Additionally, the first substantive hearing in the Beijing copyright infringement case took place at the Beijing No. 1 Intermediate People's Court. Finally, in the U.S. Department of Justice's case against Sinovel, members of its senior management team, and AMSC's former employee, the United States District Court for the Western District of Wisconsin upheld an earlier ruling that the service of summons of the criminal complaint was valid.

One of GE's Brazilian divisions scraped a contract to construct an industrial plant at Brazil's Acu Port in Rio de Janeiro, according to The Wall Street Journal, citing the port's operator. The CEO of Prumo Logistica Global Edwardo Parente said that another GE arm has entered discussions with Prumo regarding interest to lease a more expensive piece of land within the port. India will invest $100B in renewable energy over the next four years, the country's Power, Coal and Renewable Energy Minister Piyush Goyal said today, according to Economic Times. The country has also decided not to impose tariffs on foreign solar energy companies, the minster indicated, according to the newspaper. Publicly traded solar energy companies include Canadian Solar (CSIQ), First Solar (FSLR), JA Solar (JASO), SunPower (SPWR), Trina Solar (TSL) and Yingli Green Energy (YGE). A joint venture of GE (GE) and Ferus Natural Gas Fuels,along with Statoil (STO) announced the planned expansion of a pilot project to capture flare gas and use it to power up to six of Statoil’s drill rigs and one frac fleet in North Dakota. The expansion is the first step by Statoil to move into full commercial adoption of the GE and Ferus NGF joint venture’s Last Mile Fueling Solution, which is expected to reduce emissions and provide cost-savings and logistics solutions for the company’s Bakken oilfield operations. The company anticipates this new commercial expansion will increase its flare gas capture to between 3M-5M standard cubic feet per day by the end of 2014, equating to GHG emissions reductions of between 120K and up to 200K metric tons per year, or the equivalent of removing between 25K-45K cars from the road.

American Superconductor said in a regulatory filing that on September 1, the company received notification that the Arbitration Tribunal for the ICC International Court of Arbitration issued an award, dated August 29, in the arbitration proceedings between the company’s wholly-owned Austrian subsidiary, AMSC Austria GmbH and Ghodawat Energy Pvt. Ltd., a company registered in India and a former licensee of AMSC Austria’s wind turbine technology, relating to Ghodawat’s claim that AMSC Austria breached the license agreement between the parties. The ICC Court found that AMSC Austria breached the license agreement and awarded Ghodawat approximately $11M in damages and costs, including interest. The award bears interest at the Singapore judgment rate, which is currently 5.33%, from the date of the award until paid. The Company is exploring its options with respect to the award.The company’s insurer sought and received a ruling from the Massachusetts Superior Court that coverage does not apply to this award. The company is currently reviewing its options regarding the ruling. As a result, there can be no assurance that there will be insurance coverage available to offset any amounts paid out in conjunction with the award.

GE Healthcare, a unit of GE, announced the FDA approval of SenoClaire. In collaboration with Massachusetts General Hospital, GE developed SenoClaire technology that uses a low-dose short X-ray sweep around the positioned breast with nine exposures acquired with a “step-and-shoot” method, removing the potential motion from the tube helping to reduce blur and increase image sharpness.
