10:26 EDTUTLUnitil says court denies certification of class action
On January 7, the Worcester Superior Court issued its decision denying plaintiffs’ motion to certify the case as a class action. As a result of this decision, the lawsuit will now continue with only the twelve named plaintiffs seeking damages. The company continues to believe the suit is without merit and will defend itself vigorously. In early 2009, a putative class action complaint was filed against Unitil's Massachusetts based utility, Fitchburg Gas and Electric Light Company. As previously reported, the complaint seeks an unspecified amount of damages, including the cost of temporary housing and alternative fuel sources, emotional and physical pain and suffering and property damages allegedly incurred by customers in connection with the loss of electric service during the ice storm in Fitchburg’s service territory in December, 2008. Following several years of discovery, the plaintiffs in the complaint filed a motion with the Court to certify the case as a class action.

The company said, "The company’s results are expected to reflect the seasonal nature of the natural gas businesses. Accordingly, the company expects that results of operations will be positively affected during Q1 and Q4, when sales of natural gas are typically higher, and negatively affected during Q2 and Q3, when gas operating and maintenance expenses usually exceed sales margins in the period."
