Twitter (TWTR) is expected to introduce a new music strategy this week after pulling its Music app last week from Apple's (AAPL) iTunes store, the Wall Street Journal reports. According to a source, the company is ditching the idea of a separate app and could instead incorporate content in the service, possibly involving partnerships with music-streaming companies. Another source says Twitter this week met with Beats Music to propose a partnership. Reference Link

Baird said Amazon's (AMZN) launch of the "Local Register" payment and card reader system is not a surprise after the company's acquisition of assets from GoPago and that the move is complementary to Amazon's e-commerce platform. Baird said Amazon's system will compete with Square and eBay's (EBAY) payment product "Here" and added that it expects Google (GOOG) and Apple (AAPL) to expand their existing payment initiatives. The firm maintains its Outperform rating and $400 price target on Amazon.com.

In May, the company completed its acquisition of privately held Gnip, a provider of social data and analytics headquartered in Boulder, Colorado. The acquisition is expected to allow the Company to further enhance its data analytics capabilities. Under the terms of the acquisition, the company agreed to pay $107.3M in cash and issue a total of 0.6M shares of common stock including shares of restricted stock subject to continued employment in consideration of all of the issued and outstanding shares of capital stock of Gnip. In addition, the Company agreed to issue up to 0.4M shares of the companyís stock as a result of assumed Gnip equity awards held by individuals, who will continue to provide services to the Company. The fair value of total consideration of $134.1M. During the six months ended June 30, the company acquired four other companies, which were accounted for as business combinations. The total purchase price of $55.5M for these acquisitions was preliminarily allocated as follows: $9.2M to developed technologies, $1.4M to net tangible assets acquired based on their estimated fair value on the acquisition date, $1.3M to deferred tax liability, and the excess $46.2M of the purchase price over the fair value of net assets acquired to goodwill. Goodwill resulting from these acquisitions is not expected to be deductible for U.S. income tax purposes.

VirnetX (VHC) announced that on August 8 the U.S. District Court for the Eastern District of Texas, Tyler Division, issued its patent claim construction, or "Markman" Order and ruled on a VirnetX motion in the ongoing patent infringement action between VirnetX and Apple (AAPL). Both parties had presented arguments on the disputed terms along with various other motions at a Markman hearing on May 20. In the Markman order, the court denied Apple's Motion for Summary Judgment of Indefiniteness, in which Apple alleged that some of the disputed claims terms in the patents asserted by VirnetX were invalid for indefiniteness. In a separate order, the court granted in part and denied in part VirnetX's Motion for Partial Summary Judgment on Apple's Invalidity Counterclaims. The court's order precludes Apple from asserting invalidity as a defense against infringement of the claims that were tried before a jury in VirnetX's prior litigation against Apple. Apple is not precluded from asserting invalidity as a defense against infringement of the claims that were not tried before a jury in the Apple I case. "We are extremely pleased with the court's rulings and we remain confident in the merits of our complaint against Apple," said Kendall Larsen, VirnetX CEO and President. "We believe the court's Markman Order and motion ruling represents another significant step towards the successful resolution of this litigation."
