15:14 EDTSTIU.S. government, states reach $968M agreement with SunTrust
The Justice Department, Department of Housing and Urban Development and the Consumer Financial Protection Bureau, along with 49 state attorneys general and the District of Columbia's attorney general have reached a $968M agreement with SunTrust Mortgage to address "mortgage origination, servicing, and foreclosure abuses." As part of the settlement, SunTrust has agreed to pay $418M to resolve its potential liability under the federal False Claims Act for originating and underwriting loans that violated its obligations as a participant in the Federal Housing Administration insurance program. The agreement resolves potential violations of civil law based on SunTrust deficient mortgage loan origination and servicing activities. The agreement does not prevent state and federal authorities from pursuing criminal enforcement actions related to this or other conduct by SunTrust.

SunTrust, disclosed in a regulatory filing that it has been cooperating with the United States Attorney's Office for the Southern District of New York in a broader based industry investigation regarding claims for foreclosure-related expenses charged by law firms in connection with the foreclosure of loans guaranteed or insured by Fannie Mae, Freddie Mac, or FHA. The investigation relates to a private litigant qui tam lawsuit filed under seal and remains in early stages. The Southern District and SunTrust engaged in dialogue regarding potential resolution of this matter as part of the National Mortgage Servicing Settlement, but were unable to reach agreement. The Southern District has not yet advised SunTrust how it may proceed in this matter. The company's financial statements at June 30 reflect the company's current estimate of probable losses associated with the matter.
