Spectra Logic announced that it filed its response to Overland Storage, Inc.’s recently initiated patent infringement lawsuit. The response sets forth Spectra Logic’s contentions that Overland’s asserted patent claims are invalid and not infringed. Spectra Logic’s response includes relatively unique defenses that Overland’s request for damages is completely extinguished due to Overland’s unusually long delay and misleading conduct in connection with the lawsuit. Spectra Logic also filed a Motion to Stay Overland’s recently filed lawsuit pending the outcome of similar proceedings currently in process with the International Trade Commission.

The International Trade Commission has agreed and has granted Overland's petition to review the initial findings of the Administrative Law Judge regarding its patent lawsuit, the company said. Overland added: "It has been and continues to be Overland's position that the BDT FlexStor II products do infringe on Overland's Patents. If the Commission reverses the Administrative Law Judge's initial findings, Overland expects the Commission to enter an exclusion order instructing the US Customs Department to stop the libraries from being imported into the United States by BDT. The exclusion order would go into effect after a 60-day presidential review period."

Cyrus Capital disclosed in a regulatory its proposal to Overland Storage that the company pursue a business combination with Tandberg Data. Cyrus stated, "As you are aware, Cyrus and FBC Holdings Sarl, an affiliate of Cyrus and Tandberg’s shareholder, have been in discussions with you about a business combination between Tandberg and Overland for some period of time. Each party has completed substantial due diligence, has shared financial information and collectively examined the synergies and value creation that could be realized by a combination of the two businesses."

06:36 EDTOVRLOverland Storage successfully petitions ITC to review ALJ findings
Overland Storage announced that the U.S. International Trade Commission has released a Notice of Commission Decision to Review in Part the Administrative Law Judge's Remand Initial Determination in the patent infringement action filed by Overland Storage against BDT. Overland Storage previously reported that the ITC and District Court actions against IBM and Dell had been resolved by settlement. The Notice of Commission Decision stated that the ITC has granted Overland Storage's petition to allow the full Commission to review the Administrative Law Judge's findings regarding both of the Overland Storage patents asserted against BDT. Specifically, the full Commission will review the Administrative Law Judge's finding that the BDT FlexStor II products do not infringe claim 16 of U.S. Patent No. 6,353,581, which relates to the "mail slot" feature in automated media devices. The Commission will also review the Administrative Law Judge's finding that the asserted claims of U.S. Patent No. 6,328,766, which relates to "partitioning" of automated media devices, are invalid based on an IBM operator's guide. The commission announced that "having considered the evidence of record, and the parties' submissions, the Commission has determined to review" those findings. If the Commission reverses the Administrative Law Judge's decision regarding the '581 patent, Overland Storage will likely be entitled to relief under Section 337 of the Tariff Act of 1930. If the Commission reverses the Administrative Law Judge's decision regarding claims of the '766 patent, those claims will likely be found valid by the ITC. The full Commission's decision is currently due to be issued by June 25.
