Microsoft (MSFT), Apple (AAPL), and Cisco (CSCO) says the U.S. government has no right to seize computer data stored outside the country, reports the Associated Press. Lawyers for the companies say recent rulings threatens to rewrite the Constitution's protections against illegal search and seizure. 14:55 EDTTFrontier Communications confirms settlement with Connecticut AG over AT&T deal
Frontier Communications (FTR) announced it has reached an agreement with the Connecticut Attorney General and the Office of Consumer Counsel related to Frontierís proposed acquisition of AT&T's (T) incumbent local exchange operations and statewide fiber network that provides services to residential, commercial and wholesale customers in Connecticut. As part of the transaction, Frontier will also acquire AT&T's U-verse video and satellite TV operations in Connecticut. Highlights of the agreement state that for a period of not less than 36 months after the closing of the transaction (i) there will be no increases in the basic primary residential rate in effect for transferred exchanges as of the closing date; and (ii) where available, Frontier has agreed to offer its basic broadband and stand-alone basic broadband product at or below Frontierís current prices. In addition, Frontier has committed to incremental capital investments totaling $63M over 2015, 2016 and 2017 to expand and improve broadband in Connecticut.

In the last three months the stock has outperformed the broader averages, rising by nearly 9%. The trend in that time has been up, but with the bulk of gains having been realized near the start of the period. There was one larger bump up in price that was corrected, but that high at $26.08 now becomes an objective for bulls to take out on the upside on good news. The reason for this is that the $26 to $26.50 area forms a big double top when viewed on a 2-year daily chart. The bulls need to break this area of resistance for the stock to become long-term bullish. If they can manage that, next resistance above $26.50 would be at $27.74. If the news disappoints, that potentially bearish double top pattern could asset itself. The $23.50 area on a break lower would be the first test. The middle of the "M" pattern would be at $21.27.

Spherix (SPEX) subsidiary Guidance IP has reached a settlement with AT&T (T), according to a court document filed August 7 in the U.S. District Court for the Northern District of Texas. The settlement stems from a lawsuit filed on December 6, 2013 by Spherix for infringement of its patent entitled, "System and Method for Determining the Geolocation of a Transmitter." Shares of small-cap Spherix are up 19% to $1.75 in later afternoon trading following the circulation of the court filing. Reference Link

VirnetX (VHC) announced that on August 8 the U.S. District Court for the Eastern District of Texas, Tyler Division, issued its patent claim construction, or "Markman" Order and ruled on a VirnetX motion in the ongoing patent infringement action between VirnetX and Apple (AAPL). Both parties had presented arguments on the disputed terms along with various other motions at a Markman hearing on May 20. In the Markman order, the court denied Apple's Motion for Summary Judgment of Indefiniteness, in which Apple alleged that some of the disputed claims terms in the patents asserted by VirnetX were invalid for indefiniteness. In a separate order, the court granted in part and denied in part VirnetX's Motion for Partial Summary Judgment on Apple's Invalidity Counterclaims. The court's order precludes Apple from asserting invalidity as a defense against infringement of the claims that were tried before a jury in VirnetX's prior litigation against Apple. Apple is not precluded from asserting invalidity as a defense against infringement of the claims that were not tried before a jury in the Apple I case. "We are extremely pleased with the court's rulings and we remain confident in the merits of our complaint against Apple," said Kendall Larsen, VirnetX CEO and President. "We believe the court's Markman Order and motion ruling represents another significant step towards the successful resolution of this litigation."
