05:58 EDTMRKAblynx collaborates with Merck to develop therapeutic nanobody candidates
Ablynx announced a collaboration with Merck & Co., Inc., through a subsidiary, to develop and commercialise NanobodyŽ candidates directed towards a voltage gated ion channel with the option to develop and commercialise a Nanobody to a second target. Merck is known as MSD outside the U.S. and Canada. Under the terms of the agreement, Merck gains exclusive global rights to Nanobodies against the selected target, with an option for similar rights to a second target. Upon signing, Merck will pay Ablynx a EUR6.5M upfront payment and a EUR2.0M fee for research funding. In addition, Ablynx will be eligible to receive up to EUR448M in research, regulatory and commercial milestone payments associated with the progress of multiple candidates as well as tiered royalties on any products derived from the collaboration. Ablynx will be responsible for the discovery of Nanobody candidates and Merck will be responsible for the research, development, manufacturing and commercialisation of any Nanobody product resulting from the collaboration.

InSite Vision (INSV) announced that it will join Merck (MRK) and Pfizer (PFE) in filing a patent infringement lawsuit against Mylan Pharmaceuticals (MYL). Mylan recently filed an Abbreviated New Drug Application with the U.S. Food and Drug Administration seeking to market a generic version of AzaSite before expiration of the patents covering AzaSite and its use. AzaSite is marketed by Merck in the U.S. On May 26, 2011, InSite and Merck filed a similar patent infringement lawsuit against Sandoz. A trial date for the Sandoz ANDA suit has been set for July 11, 2013. The companies have agreed that Merck will take the lead in prosecuting both lawsuits. Each company will be responsible for their own legal costs, with InSite assuming a monitoring role, the company said.
