09:40 EDTAVY, MMM3M and Avery Dennison conclude patent infringement and related lawsuits
3M (MMM), along with its wholly-owned subsidiary 3M Innovative Properties, announced that they have successfully concluded their lawsuits against Avery Dennison (AVY) relating to retroreflective sheeting products used on traffic signs, pavement markings and other traffic control products. 3Mís patent infringement litigation against Avery has been resolved with the court entering a consent judgment in favor of 3M. Averyís separate claims of patent infringement and antitrust violations against 3M have been dismissed by the court with prejudice.

The shares have a potential bearish head and shoulders top in development. The neckline for the pattern remains at considerable distance from current price at the $155 area. It would take more bearish news than current expectations would suggest to reach the neckline. Downside potential for the pattern, if it triggers, would be to the $142 area over time. It should be noted that on a long-term chart the price action of recent years has resulted in a near-vertical rise that appears unsustainable. If the news is more bullish than expected, resistance levels to watch as potential upside objectives would be at $165.99 and then at $168.16, the 52-week high and lifetime high. On a breakout above $168.16, a run to $170 to $175 may be possible.

Barclays upgraded the U.S. Paper & Packaging sector to Positive from Neutral saying stocks in the space offer investors an attractive alternative in 2015 due to improving demand and input cost reductions. The firm calls Containerboard its preferred subsector, and recommends a long position in Crown Holdings (CCK) versus Ball Corp. (BLL). The firm downgraded the latter to Equal Weight from Overweight. Barclays also upgraded to Overweight shares of Avery Dennison (AVY). It calls Berry Plastics (BERY) a top pick.
