08:39 EDTIMGN, LLYEli Lilly granted right to extend pact with ImmunoGen
ImmunoGen (IMGN) disclosed in a regulatory filing that the company and Eli Lilly (LLY) amended their Multi-Target Agreement entered into in 2011 and the first development and commercialization license that was taken thereunder in 2013. Under these amendments, Lilly now has the right to extend the three-year right-to-test period of the Multi-Target Agreement for up to two six-month periods by payment of additional consideration. In addition, Lilly will retroactively pay ImmunoGen an exercise fee of $2M for the License Agreement, with the right to elect which one of the additional development and commercialization licenses, if any, taken under the Multi-Target Agreement will have no exercise fee. Prior to these amendments, the Multi-Target Agreement provided for no extension of the right-to-test period, that no exercise fee was payable in connection with the first development and commercialization license taken thereunder, and that ImmunoGen would be entitled to receive an exercise fee of $2M for every subsequent development and commercialization license.

The amount that patients with certain diseases must pay for specialty drugs has increased significantly, a research firm reported, according to The New York Times. Meanwhile, consumers' use of health care increased in 2013 for the firm time in three years, the newspaper quoted the firm, the IMS Institute for Healthcare Informatics, as saying. Publicly traded drug makers include AstraZeneca (AZN), Bristol-Myers (BMY), Eli Lilly (LLY), GlaxoSmithKline (GSK), Johnson & Johnson (JNJ), Merck (MRK), Novartis (NVS), Pfizer (PFE), Roche (RHHBY) and Sanofi (SNY). Takeda Pharmaceuticals (TKPYY) announced last night that in the case of Terrence Allen, et al. v. Takeda Pharmaceuticals North America the jury found in favor of the plaintiffs and awarded $1.475M in compensatory damages. The allocation of liability was 75% Takeda and 25% Eli Lilly (LLY). The jury also awarded $6B in punitive damages from Takeda and $3B from co-defendant, Eli Lilly. “Takeda respectfully disagrees with the verdict and we intend to vigorously challenge this outcome through all available legal means, including possible post-trial motions and an appeal. We have empathy for the Allens, but we believe the evidence did not support a finding that ACTOS caused his bladder cancer. We also believe we demonstrated that Takeda acted responsibly with regard to ACTOS,” said Kenneth Greisman, senior vice president, general counsel, Takeda. Reference Link
