Shares of Herbalife (HLF) are sharply higher after the company reported better than expected earnings and increased its projection for fiscal year profits. In a regulatory filing associated with the earnings report, Herbalife appeared to accuse billionaire investor Bill Ackman of "manipulative activity" and suggested that a number of government agencies, including the Department of Justice, had begun investigating him. Ackman has had a large short interest in Herbalife since 2012 and he has repeatedly accused the company of operating a pyramid scheme. WHAT'S NEW: "Since late 2012, a short seller has made and continues to make allegations regarding the company and its network marketing program," Herbalife stated in an SEC filing that was disclosed last night. The statement appears to refer to Ackman, since he began shorting Herbalife's stock in late 2012. Herbalife wrote that the allegations "are without merit," and noted that it has contacted government officials about what it believes are efforts to manipulate its stock. Herbalife then appeared to suggest that various government agencies were probing its allegations about the short seller. "Because of these allegations, the company and others have received and may receive additional regulatory and governmental inquiries. For example, the company has previously disclosed inquiries from the Federal Trade Commission, Securities and Exchange Commission and other governmental authorities," Herbalife stated in its regulatory filing. In March, Bloomberg reported that the FBI was probing one of Ackman's outside consultants. WHAT'S NOTABLE: Herbalife last night reported stronger than expected results and raised its 2015 profit guidance. The company said it is "confident that it is building a stable foundation for volume and sales growth." PRICE ACTION: In midafternoon trading, Herbalife surged 20% to $48 per share.
