Nimble Storage (NMBL) announced that it has entered into a written settlement agreement with NetApp (NTAP), effective March 16, that resolves all remaining claims in the parties' outstanding litigation matters. Beginning in October 2013, NetApp initiated litigation against Nimble. The first was a lawsuit in U.S. District Court for the Northern District of California, alleging violations of the federal Computer Fraud and Abuse Act, trade secret misappropriation, and unfair competition, among other claims. The second was a lawsuit filed in May 2014 in the Superior Court of California, County of Santa Clara alleging similar claims, including trade secret and breach of contract. The terms of the settlement are confidential and are not material to Nimble's financial statements. Both cases were formally dismissed with prejudice by the U.S. District Court, Northern District of California and Santa Clara County Superior Court on March 23.

Piper Jaffray downgraded EMC (EMC) to Neutral to Neutral saying the company is facing increasing pressure from next-gen storage vendors and public cloud providers. Piper notes that it continues to hear Pure Storage and other vendors such as Nimble Storage (NMBL) are making inroads into the installed base of EMC. It cut its price target for shares to $27 from $30. The firm also downgraded NetApp (NTAP) to Neutral this morning for similar reasons, but says EMC has a more defensible position than NetApp.

WidePoint subsidiary iSYS LLC has received a Task Order renewal from the Department of Homeland Security Headquarters and a new Task Order from OBIM. Both Task Orders were issued under the Department of Homeland Security Cellular Wireless Managed Services Blanket Purchase Agreement. The renewal is worth a total of $17M if all options are exercised and is for one base year worth $5.9M and two option years. The new order from OBIM is for one base and two option years and a total value of nearly $700K if all options are exercised.

After government websites indicated that Citrix (CTXS), Amazon (AMZN) and others succeeded in getting the DoD to reconsider its awarding of a $1.6B, five-year contract to VMware (VMW), Stifel said it doesn't think VMware has necessarily lost the opportunity, but that the company will now likely face a more competitive bidding process to win the deal. The firm view this example as supporting its concerns that VMware's steps to become a more strategic vendor have the potential to be as much of a threat as an opportunity and Stifel maintains its Hold rating on the stock.

On March 12, the Defense Information Security Agency, or DISA, reversed a decision to award VMware (VMW) with a $1.6B contract following protests by Amazon Web Services (AMZN), Citrix Systems (CTXS), and others, reported siliconANGLE.
