19:37 EDTUPS, FDXFedEx, UPS to face DEA probe over pain-pill shipments, WSJ reports
FedEx (FDX) is said to be close to facing criminal charges from the Drug Enforcement Administration over whether the company has been complicit in the illegal sale of prescription painkillers, according to a Wall Street Journal report. The report also noted that UPS (UPS) disclosed in SEC filings this month that it is cooperating with a similar DEA investigation and is in talks with the Justice Department to settle their case. "During the quarter, UPS continued to invest for the future by expanding capacity and launching new capabilities that provide higher value to customers. The strong momentum in our International segment is expected to continue and gives us confidence in achieving the upper end of our guidance range," said CEO David Abney. "Even though the U.S. economy appears to be growing at a slower pace, our global portfolio and performance reinforces our expectations to attain the higher-end of the guidance range," said CFO Richard Peretz. The company's guidance for FY15 EPS is $5.05-$5.30, a 6% to 12% increase over adjusted 2014 results, consensus $5.19.

The key feature dominating the long-term chart, best seen in a 5-year view, is a potential head and shoulders top. On bearish news, the neckline of the pattern at $94 could be breached which would make the pattern active. Downside potential for the pattern would be to the $75 to $74 area. Patterns are most likely to fail during earnings given the potential for new information to run counter to expectations. If the news is a bullish surprise, upside potential would be to the $103 area, just above the right shoulder of the pattern. A move to $103 or higher would void the pattern. Next resistance levels to watch would be at $109.40 and the life high and 52-week high at $114.40.

On July 21, FedEx Corporationís wholly owned subsidiary Federal Express Corporation and The Boeing Company entered into Supplemental Agreement No. 6 to Purchase Agreement Number 3712 dated as of December 14, 2011, between Boeing and FedEx Express related to Boeing 767-300 Freighter aircraft. In the Supplemental Agreement, FedEx Express agreed to purchase 50 additional B767F aircraft from Boeing. Four of the 50 additional firm-order B767F aircraft purchases are conditioned upon there being no event that causes FedEx Express or its employees not to be covered by the Railway Labor Act of 1926, as amended. The 50 additional firm-order B767F aircraft are expected to be delivered from fiscal 2018 through fiscal 2023 and will enable FedEx Express to continue to improve the efficiency and reliability of its aircraft fleet. FedEx Express now has a total of 106 firm orders for B767F aircraft from Boeing through fiscal 2023. In the Supplemental Agreement, FedEx Express also acquired options to purchase an additional 15 B767F aircraft. As a result, FedEx Express now has options to purchase a total of 50 B767F aircraft from Boeing. Expected capital spending for FedEx Corporation for fiscal 2016 remains at approximately $4.6 billion. The impact to FedEx Corporationís capital spending in fiscal 2017 from this new B767F aircraft order is expected to be immaterial.
