Sheryl Sandberg, Facebook's (FB) COO, said in a sworn statement that she rebuffed a 2008 request from Google (GOOG) executives to limit poaching of Google employees, the Wall Street Journal reports. A lawsuit by Silicon Valley workers say an agreement not to poach among Google, Facebook, Apple (AAPL), Intel (INTC) and Adobe Systems (ADBE) suppressed wages. Reference Link

10:50 EDTINTCAnalyst more upbeat on Intel, downgrades Qorvo following trip to Asia
After traveling to Asia, Pacific Crest analyst Michael McConenell was more upbeat on the outlook for Intel (INTC), as well as smartphone chip makers Avago (AVGO) and Skyworks (SWKS). The analyst downgraded another smartphone chip maker, Qorvo (QRVO), to Sector Weight from Overweight, warning that the company's results may miss expectations down the road. BULLISH: Shipments of notebook computers appear set to exceed expectations by 5%-10% this month, after more of the devices seem to have been manufactured in August and September than in previous months, according to McConnell. Meanwhile, cloud customers are sparking a significant rebound in data centers' semiconductor demand, the analyst stated. Moreover, motherboard manufacturers say they are seeing increased demand for their products from desktop PC makers, the analyst stated. All of these trends bode well for Intel, indicated McConnell, who kept a $35 price target and Overweight rating on the shares. Demand for Avago's products appears to have remained healthy, given the company's low exposure to China and the strong demand for Apple's (AAPL) iPhone 6S devices, the analyst stated. Another research firm, Craig-Hallum, recently estimated that Avago generates $6.75 of revenue per iPhone 6S sold, up from the $6.50 it obtained from the previous generation of iPhones. Pacific Crest's McConnell kept a $180 price target and Overweight rating on the shares of Avago. Skyworks should benefit from strong near-term demand trends, driven by a shift to module architectures, McConnell contended. According to the analyst, the company's 2016 outlook is also strong. BEARISH: Analysts' "out-quarter estimates" for Qorvo are too high, as they expect the company to grow 8.4% each quarter, versus only 5.9% for Skyworks, McConnell stated. Qorvo is facing several headwinds, including struggles with a key customer, Chinese smartphone maker Xiaomi, and its inability to obtain more revenue per each iPhone sold, the analyst stated. These headwinds will probably prevent Qorvo from meeting analysts' expectations, warned McConnell. Additionally, the company will be hurt by the slowdown in the growth of the Chinese smartphone market, predicted the analyst, who cut his rating on the stock to Sector Weight from Overweight. PRICE ACTION: In morning trading, Intel rose 1.2% to $29.16, Avago dropped 1.7% to $124.56, Skyworks fell 3.6% to $84.58 and Qorvo declined 8.5% to $43.61.

The Seattle-based tech giant is inviting participants to an event in Russia on October 17, offering cardboard headsets to those with "successful" suggestions, the report says. Piper Jaffray analyst Gene Munster said Apple's report of opening weekend iPhone 6S and 6S Plus sales of more than 13M units came in at the high end of his expectation, which, paired with the firm's read on sell-through, makes him think the 6S cycle is off to a good start. The analyst, who expects iPhone 6S cycle unit growth of 3%, compared to the consensus forecast for flat growth, keeps his Overweight rating and $172 price target on Apple shares.

Network-1 Technologies (NTIP) announced that the United States District Judge Robert Schroeder III of the Eastern District of Texas issued an Order denying a motion made by Apple (AAPL) to certify for appeal the Court's prior ruling denying Apple's motion for summary judgment based on the Kessler Doctrine in a patent infringement suit filed by Mirror Worlds Technologies, Inc., a wholly owned subsidiary of Network-1, against Apple. In December 2014, Apple brought a motion for summary judgment arguing that Mirror Worlds was precluded under the Kessler Doctrine from initiating patent litigation against Apple because of an earlier case brought by the previous owner of the Mirror Worlds patent portfolio against Apple. In July, Judge Schroeder denied Apple's motion and granted Mirror Worlds' cross-motion that the Kessler Doctrine does not apply. Apple filed a motion seeking to allow it to file an interlocutory appeal (prior to a judgment) of Judge's Schroeder's Order to the Federal Circuit Court of Appeals.

Apple announced it has sold more than 13 million new iPhone 6s and iPhone 6s Plus models, a new record, just three days after launch. iPhone 6s and iPhone 6s Plus will be available in more than 40 additional countries beginning October 9 including Italy, Mexico, Russia, Spain and Taiwan. The new iPhones will be available in over 130 countries by the end of the year. "Sales for iPhone 6s and iPhone 6s Plus have been phenomenal, blowing past any previous first weekend sales results in Apple's history," said Tim Cook, Apple's CEO. "Customers' feedback is incredible and they are loving 3D Touch and Live Photos, and we can't wait to bring iPhone 6s and iPhone 6s Plus to customers in even more countries on October 9."

Further, key Knowles competitor has encountered difficulties sourcing qualified MEMS wafers from its third-party manufacturing partner, Rolland tells investors in a research note. YouTube is finalizing launch plans for its subscription service expected to be launch near the end of October, reports Re/code. In a blast email to content owners, YouTube said they would have to agree to the new terms by October 22 or their "videos will no longer be available for public display or monetization in the United States."
