News Breaks | | | | October 11, 2012 | | 07:08 EDT | | UAL, BPL, DAL, LCC, JBLU | Buckeye Partners files answer to airlines' complaint Buckeye Partners, L.P. announced that Buckeye Pipe Line Co., L.P., or Buckeye Pipeline, has filed with the Federal Energy Regulatory Commission, or FERC, its answer to the complaint filed by Delta Air Lines, JetBlue Airways, United/Continental Air Lines, and US Airways on Thursday, Sept. 20, challenging the tariff rates charged by Buckeye Pipeline for the transportation of jet fuel from its facilities in New Jersey to three New York City-area airports. In answering the complaint, Buckeye Pipeline demonstrates that the airlines' allegations regarding cost over-recovery are based on inappropriate adjustments to the pipeline's costs and revenues and, more importantly, are irrelevant because Buckeye Pipeline's rates are set under a FERC-approved program that ties rates to competitive levels. Buckeye Pipeline also seeks dismissal by FERC of the complaint to the extent it seeks to challenge the portion of Buckeye Pipeline's rates that were protected by Congress in the 1992 Energy Policy Act. Buckeye Pipeline also intends to file an application in the coming days with FERC seeking authority to charge market-based rates for deliveries of refined petroleum products to the New York City-area market. If the application is approved by FERC, Buckeye Pipeline would be permitted to set its NYC area tariff rates on the basis of competitive forces.

From 2007 through last year, U.S. airlines cut the number of scheduled domestic flights by 14%. The number of seats offered fell by slightly less, as airlines pushed passengers onto bigger planes, says the study. Reference Link
