The National Security Agency's, or NSA, ability to spy on great amounts of internet traffic has relied on a decades-long partnership with AT&T, the New York Times reports, citing newly disclosed NSA documents. The company's cooperation with the NSA has involved a broad range of activities from 2003-2013, including giving the NSA access to billions of emails and providing technical assistance in carrying out a secret court order permitting the wiretapping of all web communications at the UN headquarters, the report says. Limelight Networks announced that the United States Court of Appeals for the Federal Circuit has issued its opinion, reversing a previous decision that Limelight Networks was not liable for direct infringement of Akamai's US Patent 6,108,703. While Limelight studies all options and determines its next steps, the company believes its balance sheet is strong enough to continue to invest in the business and respond to any potential outcome in its continuing court battle with Akamai. "We are disappointed this outcome isn't aligned with the recent rulings in our favor, which were supported by many global technology and industry leading companies, and are determined to continue the process," stated Bob Lento, Limelight's chief executive officer. "Our business is strong and gaining strength. Our network traffic is growing at a record pace. We are investing in our business, improving margins and are confident of our future. We will not allow this to distract us from serving our global customers." The original lawsuit from 2006 relates to a technical architecture that has not been in use at Limelight for many years. The company continuously advances and improves its products, and the industry-leading performance delivered through the Limelight Orchestrate platform is not at issue in this long-standing dispute.

The U.S. Court of Appeals for the Federal Circuit concluded that "substantial evidence" supports the jury's finding that Limelight Networks (LLNW) directly infringes U.S. Patent 6,108,703, which is held by Akamai (AKAM). Therefore, the appeals court reverses the district court's grant of judgment of noninfringement and returned the case to a panel for resolution of all residual issues consistent with this opinion, the court stated in a published opinion on the case. Shares of Limelight Networks are down 10c, or 3%, to $3.16 in early trading.
