10:34 EDTAAPL, SSNLFSamsung denied veto of smartphone, tablet import ban
United States Trade Representative, Michael Froman, announced his decision on the results of the Obama Administrationís review of the U.S. International Trade Commission's determination in its investigation of certain smartphones and tablets. On August 9, the USITC determined that Samsung (SSNLF) had violated Section 337 of the Tariff Act of 1930, as amended, in the importation of certain devices that infringe claims of two patents owned by Apple (AAPL). Based on this determination, the USITC issued a limited exclusion order prohibiting the unlicensed importation of infringing devices manufactured for or on behalf of Samsung. The Commission also issued a cease and desist order that prevents Samsung from engaging in certain activities, such as sale of these products in the United States. Froman said, "After carefully weighing policy considerations, including the impact on consumers and competition, advice from agencies, and information from interested parties, I have decided to allow the Commissionís determination in Certain Electronic Digital Media Devices and Components Thereof, Investigation No. 337-TA-796, to become final."
